These Terms of Service ("Terms") govern your access to and use of the SafeFire Compliance Platform ("Platform"), operated by Onellys CC t/a SafeFire ("SafeFire", "we", "us", or "our"), a company incorporated in South Africa.
By registering on the Platform, clicking "I agree", or otherwise using the Platform, you ("Applicator", "you", or "User") confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy.
If you do not agree to these Terms, you must not register or use the Platform. These Terms constitute a binding legal agreement between you and SafeFire.
These Terms apply to all users of the Platform, including Applicators, administrators, and any person who accesses the Platform in any capacity.
To register on the Platform, you must be:
You warrant that all information provided during registration is accurate, complete, and current. You agree to update your information promptly if it changes. SafeFire reserves the right to suspend or revoke your account if any information is found to be inaccurate or misleading.
SafeFire will manually verify the documents and information you submit during registration, including CIPC registration status, tax clearance, and chemical test reports. Verification typically takes 1–3 business days. SafeFire reserves the right to request additional documentation and to decline any registration at its sole discretion.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify SafeFire immediately at support@safefire.co.za if you become aware of any unauthorised use of your account.
Each account represents one Competent Person. You may not generate Certificates of Compliance on behalf of another Competent Person using your account. Each CoC generated is attributed to the registered Applicator as the designated Competent Person.
Every Certificate of Compliance generated on this Platform is issued by the individual Competent Person registered to the account, acting in their personal professional capacity. This applies regardless of whether that individual is employed by, contracted to, or associated with any company, close corporation, organisation, or other legal entity ("Employer").
No Employer is a party to any CoC issued through this Platform. The declarations, technical assertions, and compliance certifications contained in each CoC are made solely by the individual Competent Person and are binding on that individual only. An Employer's name, logo, or commercial details may appear on a CoC as contextual information only and do not constitute, and shall not be construed as, an endorsement, warranty, or certification by that Employer.
Where a Competent Person operates under an Organisation account on the Platform, the Organisation provides access and billing facilities only. The Organisation does not assume, and cannot assume, the professional liability of the Competent Person for any CoC generated under their individual account.
Competent Persons who are employed or contracted acknowledge that their obligation to comply with SANS 10400-T and the National Building Regulations is personal and non-delegable. SafeFire will not, under any circumstances, recognise a claim that a CoC was issued "on behalf of" an employer rather than by the named individual.
SafeFire provides a digital platform for the creation, storage, and verification of flame retardant treatment Certificates of Compliance. The Platform does not provide flame retardant treatments itself, nor does it supervise or inspect any treatment work.
By generating a Certificate of Compliance on this Platform, you confirm and warrant that:
SafeFire does not independently verify the accuracy of the treatment details entered. The issuance of a CoC by the Platform is contingent on the accuracy of the information you provide.
Each CoC generated by the Platform is assigned a unique verification token and QR code. Any alteration of a downloaded CoC PDF after generation — including changes to property details, dates, or chemical information — voids the certificate and may constitute fraud under South African law. The Platform's verification page (safefire.co.za/verify) is the authoritative source for certificate validity.
The validity period of each CoC is determined by the venue type and applicable SANS standard selected at the time of generation. SafeFire is not liable for certificates that expire due to changes in circumstances at the treated property after issuance.
SafeFire reserves the right to revoke any CoC if it determines, in its sole discretion, that the certificate was generated based on inaccurate information, in breach of these Terms, or in contravention of applicable SANS standards. Revocation will be reflected on the public verification page.
A Platform Fee is charged per Certificate of Compliance generated. The applicable fee is displayed on the payment screen before you proceed. Payment is processed via Yoco, a registered South African payment service provider. The Platform Fee is non-refundable once a CoC has been generated.
Certain features, including specialisation category listings and the public applicator directory, may be subject to monthly Subscription Fees. Subscription Fees are disclosed at the time of registration and are charged from the date your account is approved. Subscriptions continue on a month-to-month basis until cancelled from your profile settings.
SafeFire is currently in the process of registering for VAT. Once registration is complete, all fees will be stated inclusive of VAT at the current South African statutory rate (15%) and SafeFire's VAT registration number will be displayed on tax invoices. In the interim, fees are charged exclusive of VAT and no VAT is levied.
If a payment fails after a CoC has been generated, SafeFire reserves the right to suspend your account until the outstanding amount is settled. SafeFire will not issue duplicate CoCs for the same job without additional payment.
Approved Applicators may be listed on the SafeFire public applicator directory. Listing in the directory is a privilege, not a right, and may be withdrawn at any time if your account is suspended or your credentials lapse.
SafeFire verifies credentials at the time of listing. It is your responsibility to ensure your credentials remain current. SafeFire does not continuously monitor credential expiry and is not liable for any claims arising from an outdated directory listing.
By opting into the directory, you consent to the display of your company name, trading address, service areas, and contact information as provided during registration.
You agree not to:
Breach of any of the above may result in immediate account suspension, revocation of all CoCs issued under your account, and referral to relevant professional or regulatory bodies.
All content, design, software, and materials on the Platform, including the SafeFire name, logo, and certificate templates, are the intellectual property of Onellys CC t/a SafeFire and are protected under South African law.
You are granted a limited, non-exclusive, non-transferable licence to use the Platform solely for the purposes described in these Terms. This licence does not include the right to reproduce, distribute, or create derivative works from any Platform content.
The CoC PDFs generated by the Platform are issued to you for delivery to your clients. SafeFire retains the right to display and host the certificate data on its verification pages.
SafeFire is a technology platform provider. We are not a flame retardant treatment company and do not certify the quality, adequacy, or correctness of any treatment. The professional responsibility for each CoC rests solely with the registered Applicator as the designated Competent Person.
To the maximum extent permitted by South African law:
Nothing in these Terms limits SafeFire's liability for fraud, gross negligence, or any liability that cannot lawfully be excluded under South African law.
You agree to indemnify and hold Onellys CC t/a SafeFire, its directors, employees, and agents harmless from and against any claim, loss, damage, liability, cost, or expense (including legal fees) arising from:
SafeFire may suspend or terminate your account at any time if:
On suspension, your ability to generate new CoCs will be immediately paused. Existing CoCs remain on the verification system unless individually revoked. You may contact support@safefire.co.za to understand the reason for suspension and to appeal.
You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of any fees paid.
These Terms, all CoCs, tax invoices, and communications from SafeFire are issued electronically. In terms of sections 13(1) and 14 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA), electronic records and advanced electronic signatures have full legal effect and are admissible as evidence in legal proceedings. The unique token and digital timestamp embedded in each CoC constitute a digitally signed record for ECTA purposes.
SafeFire may update these Terms from time to time. We will notify registered Applicators by email at least 14 days before any material changes take effect. Your continued use of the Platform after the effective date of updated Terms constitutes acceptance of the new Terms. If you do not accept the updated Terms, you must cease using the Platform and notify us to close your account.
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or in connection with these Terms shall first be referred to mediation. If mediation fails, the dispute shall be submitted to the jurisdiction of the South Gauteng High Court (or such other competent court as SafeFire may elect), and you consent to the jurisdiction of such court.
